Freedom of Information

Under the Freedom of Information Act 2000, all individuals have a right of access to information that is held by public authorities, including further education colleges.

Activate Learning is committed to openness in relation to its communities and to the general public, and has adopted the Information Commissioner’s Office’s model publication scheme for further education colleges. Accordingly, information specified in the model publication scheme are published on this website, unless:

  • We do not hold the information;
  • The information is exempt under one of the Freedom of Information exemptions or Environmental Information Regulations (EIRs) exceptions, or its release is prohibited under another statute;
  • The information is archived, out of date or otherwise inaccessible; or
  • It would be impractical or resource-intensive to prepare the material for routine release.

Making a request

If you wish to access information about Activate Learning that is not already available on this website, you may make a request under the Freedom of Information Act. Anyone can make a request for information; there are no restrictions on your age, nationality or where you live.

Subject to the exemptions provided in the Act, anyone who makes a request to Activate Learning will be informed whether we hold the information requested and, if we do, the information will be supplied. Where the information requested is already published, either by ourselves or by another public authority, we will inform you how you can access the information.

Please note that you cannot use a Freedom of Information request to obtain personal information relating to yourself or others; if you would like to access information held about you by Activate Learning, you should instead make a Subject Access Request.

Please note that, unless otherwise specified, all requests will be answered in respect of the Activate Learning group, including all college campuses operated by Activate Learning.

We are able to process most FOI requests for free, but you might be asked to pay a small administrative fee. In these cases you will be informed when we acknowledge your request.

You should receive the information within 20 working days, unless your request is particularly complex or time-consuming. If we need more time to fulfil your request, we will contact you and tell you when you can expect the information.

We can refuse to release certain information to the public under the following circumstances:

  • it is not information we currently hold;
  • it is exempt under the Act;
  • it would cost too much or take too much staff time to deal with the request.

Raising a concern

If you have any concerns about the way we have handled your request, please let us know in the first instance, by completing our complaints form. We take our obligations under the Act very seriously and will work with you to investigate and resolve your concerns.
